Terms & Conditions
Rental Policies
a) Prices, equipment availability and rental policies are subject to change without notice.
b) Standard chairs have a maximum capacity of 300 pounds, and Premium chairs have a maximum capacity of 265 pounds.
c) Should any equipment be damaged, lost, or stolen while in the customer’s care (including if unattended), the renter will be responsible for all replacement costs shown below.
d) You must be 18yrs old or older to rent one of our products.
e) Payment in full for all rentals is due at the time of booking.
DIY Shade Policies
a) At time of us delivering the equipment, you are responsible for inspecting all equipment carefully and to bring any missing or damaged equipment to our attention before we leave. Make sure any discrepancies are noted on the agreement. Failure to note any discrepancies may result in a fee for damaged or missing equipment.
b) Equipment must be returned to the point of delivery and/or a pre-agreed pick-up location within 15 minutes of the time and date listed on your reservation. Returns later than 15 minutes of the listed time may incur a late fee of $20 every 30 minutes late.
c) Individual named on the booking must be present at the both time of delivery and pick-up of equipment. Individual must present photo I.D. and/or valid driver’s license at time of delivery.
Cancellation Policy
a) Cancellations must be made no less than 24 hours prior to scheduled start time to receive a full refund.
b) Bookings rescheduled within the 24 hour window remain non-refundable, even when canceled at a later date.
Weather Policy
a) Beachfront Bliss bookings during winds over 15 MPH will not include the Neso tent and will be provided a partial refund.
b) DIY Shade bookings during winds over 15 MPH will not set up the Neso tent, and will be responsible for tent damages and replacement costs.
c) Cancellations due to weather must be made no less than 3 hours prior to scheduled start time to receive a full refund.
d) Sun & Shade reserves the right to cancel/modify/reschedule any reservation due to inclement weather.
Replacement Costs
a) 7FT x 7FT Tent - $175.00 per unit
b) 9FT x 9FT Tent - $200.00 per unit
c) 11FT x 11FT Tent - $250.00 per unit
d) Beach Wagon - $225 per unit
e) Standard Chair - $100 per unit
f) Premium Chair - $150 per unit
g) Towel - $20 per unit
h) Cooler - $35 per unit
i) Table - $60 per unit
j) Trash Bin & Lid - $55 per unit
k) Speaker - $35 per unit
l) Pickleball Set - $100 per unit
m) Spikeball - $50 per unit
n) Sand Toys Set - $30 per unit
o) Football - $20 per unit
p) Volleyball - $20 per unit
q) Mini Beacher Chair - $60 per unit
r) Mini Beacher Poncho - $40 per unit
Liability Waiver
a) The Renter hereby agrees that by renting this equipment from Sun & Shade FL, LLC the Renter accepts liability for any damages or injury that may occur while using any of the equipment, regardless of its condition rented from Sun & Shade FL, LLC. By signing this agreement, the Renter understands that they are waiving their right to bring any court action to recover compensation or to obtain any other remedy for any injury to themself, their property, or their death, however caused, arising out of my use of any equipment belonging to Sun & Shade FL, LLC. The Renter understands there are inherent risks associated with water sports. The Renter acknowledges that they have the necessary skills to use the above rented equipment properly. The Renter also acknowledges that they will use the equipment in a safe manner that is not contrary to the recommended use or manufacturer’s standards. The Renter is aware of hazards associated with the use of outdoor equipment, including, but not limited to physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. The Renter understands that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
b) The Renter understands that equipment is provided for their use. The Renter agrees that they will be solely responsible for proper use of safety and other equipment and procedures. It is the Renter’s responsibility to inspect all equipment prior to use. The undersigned user (The Renter) or guardian of The Renter HEREBY RELEASE on behalf of themselves, their heirs, representatives, successors, executors, and administrators Sun & Shade FL, LLC, its officers, agents, and employees from any cause of action, claims, or demands of any nature whatsoever including, but not limited to, a claim of negligence. The Renter expressly agrees and promises to accept and assume all of the risks existing in this activity. The Renter’s participation in the activity is purely voluntary and the Renter elects to participate in spite of the risks. The Renter agrees to hold harmless and/or indemnify and defend Sun & Shade FL, LLC and their officers, agents, and employees from all liability, costs, or expenses resulting from accidents or injury to -- or for the death of – any person or property directly or indirectly arising from the Renter’s use or their permission, express or implied, to use the rental equipment.
c) The Renter also agrees that if they damage, lose, or misplace any item they rent from Sun & Shade FL, LLC that the Renter will pay for these losses or damages according to the prices listed on this form. The Renter agrees that if Sun & Shade FL, LLC incurs any costs associated with the recovery of payment for damages or losses (such as court costs) that the Renter will reimburse or pay Sun & Shade FL, LLC for these costs as well as the cost of the damaged or lost items. Beach Equipment will be charged at the full price of replacement. If the Renter does not return the rented item within 24hrs of the time due back that was agreed at booking, the Renter authorizes Sun & Shade FL, LLC to charge the full replacement purchase price of the products (see REPLACEMENT COSTS) to the Renter’s credit card in addition to the rental fees already incurred and late fees. The Renter understands and agrees that they are fully responsible for any damage to the product or loss during the time it is in their possession and if damage or loss occurs, the Renter authorizes Sun & Shade FL, LLC to charge the cost of replacement of repair to their credit card.
d) It is solely the decision of Sun & Shade FL, LLC to determine if damaged equipment will be repaired or replaced at the Renter’s expense.
